Extraordinary circumstances
Airlines do not owe fixed cash compensation when the delay is caused by circumstances outside their control - but the bar is high and airlines often overuse this defense.
Often accepted
- Severe weather that makes flying unsafe
- Air traffic control restrictions beyond airline control
- Security risks, some political unrest, volcanic ash
Often not accepted
- Technical problems (usually airline’s responsibility)
- Staff strikes by the airline’s own crew
- “Operational reasons” without detail
- Routine maintenance issues
If an airline rejects your claim citing extraordinary circumstances, ask for specific evidence. Claim partners often win cases airlines initially deny. See how to escalate a claim and check eligibility with the calculator.
